Reference: UGC (minimum qualifications for appointment of teachers and other staffs in universities and colleges and other measures for the maintenance of standards in higher education) Regulations, 2010

Subject: Request for amending cut off date (i.e. 31.12.2008) for CAS and adopting the date of notification (i.e. 30th June, 2010) as cut off date for CAS also.

Dear Sir,
I, on fehalf of teachers of Degree Colleges/......../ university of ........, wish to invite your kind attention towards the anomalies in the newly notified Regulations 2010 vide Letter No. F.3-1/2009 dated 30th June, 2010 as follows:
1- That the provisions with regard to promotion of teachers under CAS are totally misconceived and will not lead to academic improvement and development.
2. That the regulations are notified on 30th June, 2010 but for Career Advancement Scheme, the cut-off date is fixed arbitrarily on 31st December, 2008 under provisions 1.3 of the above letter.
It is to be mentioned that eligibility criteria and regulations/guidelines can not be implemented with retrospective effect. When the UGC uploaded (which was later withdrawn) the regulations vide letter no. F-3.1/2009(PS) in the month of Sept. 2009 on its website, it provided under para 1-iii
“They shall come into force with immediate effect from the date on which these Regulations are notified. However, all promotions under CAS Schemes shall continue to be governed by the above referred Regulations vide No. F.3-1/2000, in case such candidate has become eligible for promotion on a date prior to the present Regulations coming into force.”
The fixation of cut off date for CAS earlier to date of notification is unjust and against the law. I, therefore, on behalf of teaching community request you to kindly amend the of implementation of the scheme for CAS and make it effective from 30th June, 2010 and also allow the teachers who have become eligible for promotion under CAS before the the date of notification of the regulations 2010(i.e. 30th June, 2010) to be promoted under Regulations vide No.F.3-1/2000(PS) dated 4th April 2000.

Thanks Dr. Yadav for the useful and timely blog. I just want to add one issue 'that the UGC by its order no. F.1-2/2009(EC/PS) dtd 19.02.2010 had asked the educational institutions to continue promotion of teachers as per the existing regulations till new regulations are finalised and this order contradicts the earlier order completely'. Should teachers promoted in terms of that order will settle for a demotion now? This is quite baffling.

In the MHRD Notification dated 31-12-2008, which forms part of the UGC Regulations -2010, Section 2(a) (xi) states that ‘Readers/ Lecturers (Selection Grade) in service at present shall continue to be designated as Lecturer (Selection Grade) or Readers as the case may be, until they are placed in the Pay Band of 37,400 – 67000 and redesignated as Associate Professor in the manner as described in (x) above. It is clear that Readers/ Lecturers (SG) as on 31-12-2008 would be automatically placed in the Pay Band IV as and when they completed 3 years. This clause is differentiated from clause (xii) which speaks about Assistant Professors completing 3 years of teachoing in the AGP of Rs 8000 shall be eligible subject to other conditions that may be prescribed by the UGC’.

But in some States section 2(a) (xi) has not been implemented as they are confusing it Section 2(a) (xii) .

Hence such of those teachers who were Readers/ Lecturers (SG) on 31-12-2008 and who completed 3 years before 27-06-2010 should be redesignated as Associate Professors and placed in the Pay Band IV without insisting on PBAS and interviews.
