The 5th UGC pay commission for teachers, w.e.f. 1.1.1996, endorsed by the ICAR was implementated in State Agricultural Universities by all the states.The regulation was to be implemented without any modification of the guidelines, except date of implementation.
However, Government of Gujarat didn't extend the benefit of conveyance allowance, and issued resolution for withdrawl and recovery (w.e.f. 26.04.2000 ) of incentives of advance increments for attainment of additional qualification (Ph.D.) during the service period.
Is it justifiable and lawful ? Requsted for guidance for suitable action ,if unjustifiable and unlawful.
Further, for promotion to the post of Professor under CAS an Associate Professor should have 8 years experince with Ph.D.
Prior to 1.1.96, in accordance with the recruitment rules, one M.Tech.(Engineering) (Ph. D. was not essential qualification) holder Assistant Professor was recruited as Associate Professor (on 31.07.1994).He completed eight years on 30.07.2002 and Ph.D. on 15.09.2005.Solicited guidance for his eligibility date for the post of Professor under CAS in 5th pay commission.
